Categories Eligible for Notice Indemnity Under Kuwaiti Law
This includes workers in the private sector (under Law No. 6 of 2010) and workers in the oil sector (under Law No. 28 of 1969), where the notice period is determined based on salary and the nature of the work.
Second: Notice Period
Notice Period According to Kuwaiti Labor Laws
Monthly-paid workers: Three months in the private sector and one month in the oil sector.
Weekly-paid or piece-rate workers: One month in the private sector and 15 days in the oil sector.
Third: Worker’s Rights
Worker’s Rights During the Legal Notice Period
The worker is entitled to one full day off per week to search for a new job if the notice is given by the employer.
The employer has the right to exempt the worker from work while still paying their salary for the entire notice period.
Note: The employer cannot issue a notice during the worker’s leave; if done, the notice is considered invalid.
If the employer accepts the worker’s resignation, neither party can claim a notice period.
Fourth: Compensation
Compensation Due for Contract Termination Without Notice
If the contract is terminated without respecting the notice period, the violating party must compensate the other with an amount equal to three months’ salary for monthly-paid workers in the private sector.
For monthly-paid workers in the oil sector, the compensation is one month’s salary. For weekly-paid or piece-rate workers, the compensation is one month’s salary in the private sector and 15 days’ salary in the oil sector.
Fifth: Cases of Notice Period Non-Compliance
Exceptional Cases Allowing Contract Termination Without Notice
Employer’s Right to Terminate Without Notice: If the worker commits gross misconduct or discloses work secrets. If the worker obtained the job through fraud or committed a legally punishable crime.
Worker’s Right to Resign Without Notice: If the worker is physically assaulted by the employer or their representative.
If the contract is terminated during the probation period.
