Workers in the Private Sector
- The nationality field is not to be included.
- Calculations are made based on the service period as follows:
- The annual leave entitlement is 30 days multiplied by the total years, months, and days of service (as indicated in the end-of-service benefit).
- The monthly wage is divided by 26 days to determine the daily wage.
If a private sector employee indicates that their period of service is six months or less, no leave compensation is calculated. Instead, the following note is written:
“Not entitled to leave balance compensation as you have not completed six months of service, in accordance with Article 70 of Law No. 6 of 2010.
Workers in the Oil Sector
- The nationality field is not to be included.
- Two fields must be added: (Employee on a monthly wage – Employee on a daily or weekly wage). A note must be written next to the daily or weekly wage stating the total amount the worker receives monthly.
- Calculations are made based on the service period as follows:
- An employee on a monthly wage is entitled to 30 days of paid leave during the first five years, increasing to 40 days in subsequent years.
- Employees who are not on a monthly wage are entitled to 21 days of paid leave during the first five years, increasing to 30 days thereafter.
If an oil sector employee indicates that their period of service is one year or less, no leave compensation is calculated. Instead, the following note is written:
“Not entitled to leave balance compensation as you have not completed one year of service, in accordance with Article 12 of Law No. 28 of 1969.
Note
In all cases, a field must be included for the number of leave days already taken from the total balance, showing the days of leave used during employment, which must be deducted from the total when calculating the final entitlement.
